Please read these Terms of Service carefully before using the Take a Bite platform. These terms constitute a legally binding agreement between you and Take a Bite, Inc.
By downloading, installing, or using the Take a Bite application or website, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including customers, restaurant partners, and delivery drivers.
You must be at least 18 years old to create an account and use the Service. By using the Service, you represent and warrant that you meet this requirement. Take a Bite reserves the right to terminate accounts of users who misrepresent their age.
To place orders, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorised access to your account.
When you place an order through Take a Bite, you are entering into a contract directly with the restaurant. Take a Bite acts as a technology platform facilitating that transaction. All prices are displayed inclusive of applicable taxes. Delivery fees and service charges are shown at checkout before you confirm your order. Payment is charged at the time of order placement. We accept Apple Pay, major credit/debit cards, and Take a Bite gift cards.
You may cancel an order within 2 minutes of placement for a full refund. After that window, cancellations are subject to the restaurant's policy and may incur a cancellation fee. If your order is incorrect, items are missing, or there is a quality issue, you may report it within 24 hours of delivery via the app. We will review your claim and issue a refund or credit at our discretion. Refunds are processed within 3–5 business days to your original payment method.
Delivery times are estimates only and are not guaranteed. Take a Bite is not liable for delays caused by traffic, weather, restaurant preparation times, or other factors outside our control. You are responsible for providing an accurate delivery address. If a delivery cannot be completed due to an incorrect address or no one being available to receive it, you may not be eligible for a refund.
Take a Bite Bite Points are earned on qualifying orders and may be redeemed for discounts on future orders. Points have no cash value and cannot be transferred. Take a Bite reserves the right to modify, suspend, or terminate the rewards programme at any time with 30 days' notice.
You agree not to: • Use the Service for any unlawful purpose • Submit false, misleading, or fraudulent orders or reviews • Attempt to gain unauthorised access to our systems • Use automated tools to scrape or interact with the Service • Harass, threaten, or abuse restaurant staff, drivers, or support agents • Resell or commercially exploit the Service without our written consent Violation of these rules may result in immediate account termination.
All content on the Take a Bite platform — including logos, design, text, graphics, and software — is owned by Take a Bite, Inc. or its licensors and is protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works without our express written permission.
To the maximum extent permitted by law, Take a Bite shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from these terms shall not exceed the amount you paid for the order giving rise to the claim.
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in San Francisco County, California.
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before they take effect. Your continued use of the Service after that date constitutes acceptance of the revised Terms.
